Racismo ambiental à brasileira: diagnóstico introdutório da atuação dos poderes legislativo e executivo federal nos últimos 10 anos

Abstract

The present monograph presents an understanding of environmental racism, identifies how it reveals itself in the Brazilian socio-environmental context and makes an introductory analysis of the performance of the Federal Legislative and Executive Powers, in the last 10 (ten) years, regarding the issue. Currently, environmental racism affects traditional peoples, such as indigenous, quilombolas, riverside dwellers, among other socially vulnerable subjects, although the Federal Constitution guarantees as a fundamental right: access to an ecologically balanced environment, imposing on the Public Power and the community the duty to defend and preserve it for present and future generations, ensuring the dignity of the human person. The study takes a qualitative approach, using the bibliographic procedure, in order to conceptually understand environmental racism from its appearance and describe its configuration in Brazil, and the exploratory documentary procedure, for the succinct analysis of federal environmental normative acts. It is believed that the easing of environmental legislation in the country may result from the influence of the application of policies that seek, mainly, to optimize capitalist profit with the exploration of the environment, contributing to the unequal distribution of social risks, fostering the phenomenon of environmental racism.
