O Sportainment e a Lei n.º 14.193/2021: a sociedade anônima do futebol como pilar para o desenvolvimento de um novo mercado futebolístico brasileiro

Abstract

The current study verses about the analysis upon the capacity of the Law n° 14.193/2021, responsable for the institution of the S.A of football in Brazil, being the cornerstone to the development of a new market view to the brazilian football, through the opening of a set of legal relationships that didn’t exist until then in the football landscape. About this matter, the mentioned law appeared after innumerous legislative attempts to promote a change of scenery around the national footbal and through them, watching the main markets, promote the transition from only sport to the sportainment, inserting the entertainment element. Therefore, the legislator sought, through the Law n° 14.193/2021 to bring to the ecosystem the cornerstones of this new optic. With this, the justification of this study relies on its actuality and the importance growth surrounding the referred law to the country’s sports, with a diverse number of traditional clubs becoming S.As and with the economic crisis landscape on the national sports. In that regard, the main objective of this research is to know if the Law n° 14.193/2021 was able to bring the structural transformations to the brazilian football. To reach this goal, the logic-deductive method was used through the bibliographical review of articles, financial demonstrations and case study. In the context, a legal-historical analysis was realised, and also the cornerstones to the sportainment and examples of its effectiveness were shown. Successively, the brazilian reality was presented and the attempts to change it regarding the chase to becoming a main centre of sport, showing the main problems to the effectiveness of this new optic in the country. In addition, the creation of the SAF in the country was analysed and the elements that were brought to solidify the sportainment. Finally, the conclusion is that the Law brought to the system elements that enable the development of the sportainment in the country, being the SAF one of its means.
