Abstract

The research focuses on the scope of the principle of full protection for children and adolescents in the new Migration Law, in the context of combating child labor. The main objective of the study is to analyze whether the migratory legal framework is compatible with the principle of full protection in the perspective of combating child labor. The specific objectives are, firstly, to study the legal provisions concerning the full protection of children and adolescents, therefore, to investigate the scope of the principle in the new migration law and, finally, to propose the overcoming of the identified obstacles to improve the full protection of children and adolescents in a situation of refuge, notably the Latin American migratory flow. The research will adopt a deductive methodology, using a bibliographic review, consulting, respectively, the relevant legal and principled documents, as well as the position of scientists and jurists who write about the subject, as well as case studies that analyze the real condition of the migrant child in Brazil. Therefore, the New Migration Law, Law No. 13,445, enacted in 2017, brings significant changes to migration policy. However, this research finds that the law is quite succinct when it comes to combating child labor. In view of this, possible improvements are presented that effect the protection tactics for children and adolescents.
