To this end, the research was based on discussions about the criminal justice system facing the dilemmas of the female gender in an intersectional perspective, the symbolic criminalization of drugs and the criminal law of the enemy. As for the mechanisms to obtain data on the arrest of women for drug trafficking, the first stage of the research resorted to official information provided by INFOPEN and SEAP. In the second stage, 70 (seventy) sentences of women accused of the practice of illicit drug trafficking were judged, handed down within the scope of the Court of Justice of Rio Grande do Norte, in a qualitative perspective structured from pre-established key categories . The results showed that the vulnerabilities faced by women due to the female gender have a special relationship with a greater proportional number of arrests for trafficking, in comparison for males. It was also observed that there is a tendency to increase the base of the penalty, in the first phase of the dosimetry of the penalty, with justification in social gender roles.
