The professional practice in physical education, subject to legal requirements, guided by the Federal Constitution (1988). Law 9696/98 which regulated the profession of physical education and created the Federal Council of Physical Education (CONFEF) which in 2005 issued a resolution with adverse interpretation of the official of the Ministry of Education (MEC), limiting the licensee's performance in physical education outside of basic education, starting a long and bitter controversy on the licensee's performance of legitimacy in physical education, out of basic education, leading to several lawsuits. The latest decision a special appeal in the Supreme Court, signed the legality of this limitation. It attempted to analyze the legal, ethical and moral foundations of the licensee's activities beyond the school field; Clarify the differences between professional training and professional practice; Analyze possible limitations of acting both as graduates of bachelors; Present the main existing laws that permeate physical education; Establish the origin of limitations, whether legal or not so much as for bachelor graduates with regard to professional activities (9,696 / 98) .There were analyzed Laws 9.394 / 96 (LDB), Law 9,696 / 98, opinions and resolutions of MEC, CONFEF Resolution 94/2005 and its successors, and federal decisions. It was concluded that the limitation has its origin solely in the resolution CONFEF 94/2005. Assess the ethical and moral conduct of a performance out of basic education by the licensee was unable face the autonomy of higher education institutions in developing their pedagogical projects.
