The literature points out that the high generation of waste and tailings may be linked to some factors, such as the capitalist mode of production and consumption. In Brazil it is no different, in addition to being one of the countries that generates the most waste, it is also on the list of those that dispose of the most inappropriately. In 2010, the National Solid Waste Policy – PNRS was enacted, which established the integrated management and management of solid waste. One of its instruments corresponds to reverse logistics, which represents a way of economic and social development, mainly through the evolution of the recycling chain. Thus, the objective of this work was to make known the situation of the implementation of the Reverse Logistics System for post-consumer packaging in Brazil and in the state of Rio Grande do Norte. This was possible through a bibliographic survey and a case study of a food company. From then on, it was observed that even in the absence of regional legislation, this company managed to implement an SLR taking into account the guidelines of the Packaging Coalition and the Sector Agreement. Thus, it was possible to conclude that the absence of state legislation ends up limiting the progress of LR in the state.
