Tese (Doutorado em Estudos da Linguagem) - Centro de Ciências Humanas, Letras e Artes, Universidade Federal do Rio Grande do Norte, Natal, 2020.https://repositorio.ufrn.br/handle/123456789/54532This thesis analysed the textual-discursive representations (TDR) of José Dirceu and of Operation Carwash in its (re)structured redaction in the court ruling elaborated by TRF4 (Fourth Region Federal Tribunal) that denied the habeas corpus requested by Dirceu’s defence. For that purpose, we based the study on Grize’s theoretical scheme and argumentative omnipresence and on Textual-Discursive Analysis (TDA), electing a methodological approach according to Adam (2011, 2017, 2019). The research focused on the semantic and the argumentative aspects of the court ruling, highlighting schematization, TDRs and argumentative orientation. To explore the juridic discourse, this work considered researches such as the ones developed by Lourenço (2015), Nucci (2019), Rodrigues (2016), amongst others. Methodologically, we adopted the mixed method (deductive and inductive). Based on the sources used, the research is classified as bibliographical and documental and, according to its goals, is an investigation of descriptive and explanatory traits, with a qualitative outlook of the studied material. The research’s corpus is the ruling that resulted from José Dirceu’s habeas corpus judgement (503454282.2015.4.04.0000/PR), after his preventive incarceration, decreed by the 13th Federal Court of the Judiciary Subsection in Curitiba/PR in 3 August of 2015 in the context of the 17th phase of Operation Carwash. Under the argument of a lacking array of fundaments in the arrestment order, the defence formalized the habeas corpus to TRF4, occasion in which it was denied. For the analysis of the TDRs, this study uses specific textualizing operations: referencing, modification of referencing, predication and modification of predication. The results evidence different RTDs for José Dirceu that include the juridic sphere (patient, investigated subject, jurisprudential), the political universe (former Chief of Staff Minister, high ranking politician), the professional ambit (partner to his brother, consultant to company JD Assessoria e Consultoria LTDA) and the Operation Carwash investigation (operation of extraordinary dimension, biggest operation, operation of one of the most promiscuous relations between public and private interests, biggest corruption case investigated). As a result, it was noted that the lexical selection and the recategorization (re)construct Dirceu and Operation Carwash’s RTDs. Both linguistic operations are found discursively in the text, in an individualized manner, and also collectively in social spheres. The categories investigated can be considered, enunciatively, as the effects of the argumentative strategies used by the chief judges to orientate argumentatively that, as José Dirceu was the mentor of a criminal organization, the habeas corpus requested had to be denied considering the necessity or guaranteeing the public order. The processes of (re)construction of the RTDs are created within the text’s continuity and speak of the construction of meanings in the text that derivate from schematization and omnipresence of argumentation. Furthermore, the linguistic strategies of introduction and of resuming the referent characterize/qualify the object of speech peculiarly in a process of anaphoric referencing.
