Brazilian in the framework of contemporary capitalist sociability. Based on the premise that such a model not only constitutes but also intensifies the aggravation of the social issue, thus reinforcing the contradictions and class antagonism, the study was developed from a bibliographic and documentary analysis, aiming to unveil the complexity of the debate that involves socio-educational measures and forms of intervention that reproduce the criminalization of poverty. In order to understand the problem, from a qualitative and critical approach to relations, an analysis was carried out about the fundamental “role” that the State plays as a reproducer of oppression, that is, the State as one of the mechanisms of domination and exploitation of the capitalist system. Faced with the constant class struggle, the State is configured as a mediator, however, supporting the interests of the bourgeoisie based on neoliberal ideals. Therefore, constituting a coercive / punitive apparatus in dealing with the social issue and endorsing the thinking and practices of criminalizing poverty in socio-educational measures aimed at adolescents in conflict with the law. In this way, they increasingly exempt themselves from responsibility as a promoter and guarantor of the rights of children and adolescents and blaming individuals. The study points out that these, in turn, are the ones that suffer most from the achievements of social inequality; which increases the lack of protection and the punitive and criminalizing responses of the State.
