Notably, the usage of consensual instruments in the criminal sphere has shown itself to be an appropriate solution to accomplish the resolute role the criminal prosecutors have been demanded to develop after the 1988 Constitution, specially due to the public demand for celerity in order to solve conflicts. Nevertheless, the users of the new institute have been dealing with intertemporal problems concerning the possibility, or not, of executing agreements in prosecutions that began before the Law nº 13.964/20119 took place, especially considering that the parties were entrusted with the role of deciding that, and not the lawmakers. In order to make a clear point of view, this work analyses the hybrid nature of the criminal non prosecution agreement, due to its material and processual characteristics, while using dogmatic methods of scientific approach and theoretical-bibliographic research to accomplish that.
