The research begins with an analysis of the conceptual, classificatory, and functional evolution of AI, as well as its economic, social, and legal implications, and then investigates the adequacy of the current national legal framework in relation to constitutional principles and fundamental rights. In this context, legislative proposals under discussion in the Brazilian Congress, especially Bill No. 2338/2023, are examined and compared with international models, such as the European Union's Artificial Intelligence Act. The study adopts a qualitative and exploratory methodology, based on literature review, legislative analysis, and jurisprudential comparison. From this perspective, significant regulatory gaps are identified, particularly regarding civil liability for AI-related damages, informational self-determination, image rights, and the prevention of algorithmic discrimination.
