Brazilian law concerning the issue addressed some provisions on the software, but there are some limitations. It happens that the regulatory system cannot advance and monitor the international situation where the studies are focused on patent law and that have raised complex dilemmas. Such protection is based on the need to protect the non-literal elements in software and technical functions that exist behind the software concept is the real market problem.
