First, the study will emphasize the family legislative evolution in the Brazilian legal system focusing on the Federal Constitution of 1988, since it was responsible for expanding the ways of starting a family. And also, it will demonstrate the family entities plurality in the Brazilian legal system. Then, will be analyzed the socioaffectivity construction in families, demonstrating the concept of kinship, as well the filiation evolution in the Brazilian law until the socio-affective recognition; in addition, it will be presented the institute of socio-affective parenting and its legal consequences. Finally, the pursuit of happiness principle will be presented as a fundamental guideline for recognizing and applying rights to jurisdictions, and the affectivity principle as the main argument for families constrution nowadays.
