Therefore, it is necessary to investigate the concept and implementation of homeschooling throughout history, as well as its application in the international and national scenarios; analyze the decision of the STF on RE 888,815/RS, under the rapporteurship of Minister Luís Roberto Barroso, creating a lasting precedent for the Brazilian educational reality; finally, investigate whether there is compatibility between Bill No. 1,388/2022 and the Brazilian legal system, elucidating principles such as educational freedom and pedagogical pluralism, subsidiarity in the social right to education, and the comprehensive protection or best interests of the child, in addition to compliance with human rights treaties to which Brazil has committed itself before the international community. Therefore, a strategic basic research is conducted with a descriptive objective, based on documentary and bibliographic investigation of a qualitative and hypothetical-deductive nature.
