The lack of occupational hygiene in the work environment promotes conditions for the emergence of anxiety conditions, depression, Burnout Syndrome and many others, which affect the health and dignity of the worker. Once psychological damage has occurred, arises for the worker the right to compensation. The general objective of the research was, therefore, to demonstrate and understand the jurisdictional protection scenery of workers' mental health, focusing the analysis on individual compensation lawsuits for damage involving this variety of occupational diseases. The study sought to analyze in labor jurisprudential practice whether the usual criticisms of this type of compensation — especially when it comes to the complexity of establishing the causal link between work and these types of disorders — are verifiable and based on reality. This study aimed to discuss labor law and labor justice as fundamental elements in defending the principle of human dignity, focusing on the worker's right to mental health. Also proposed to analyze and warn about psychosocial risks related to work and doctrinal discussions regarding the employer's civil liability in the context of issues related to psychological pathologies suffered by the employee. Bibliographic review and document analysis methodologies were used to support the research with results extracted from scientific studies, doctrines, legislation and legal standards. This is a qualitative, basic, descriptive and bibliographical research.
