Coordenar para não falhar: a copropriedade de patentes produzidas em regime de cooperação internacional para o desenvolvimento de tecnologias. 2022. 73f. Monografia (Graduação em Direito) - Centro de Ciências Sociais Aplicadas, Universidade Federal do Rio Grande do Norte, Natal, 2022.https://repositorio.ufrn.br/handle/123456789/47022International cooperation towards the development of technologies is a growing practice among institutions dedicated to research, development, and innovation. The products reached from cooperative activities may represent new technical solutions that are eligible for patent protection. The patent privilege grants its holders an artificial monopoly for a limited time. This market reserve is important to recoup resources invested in the development of the patented product and to guarantee that the technology is not appropriated by other market agents. In this context, international cooperation gives rise to the need to jointly manage the resulting industrial property. This situation becomes even more complex when considering that cooperating entities may choose to protect their inventions within multiple jurisdictions. Thus, it is necessary to propose measures to avoid possible controversies that stem from the joint management of the intellectual asset that is derived from the technologies developed during the cooperation. To contribute towards this reflexion, this undergraduate thesis, with a qualitative approach and using the logical-deductive method, starts from the examination of specific sources (legislation, legal doctrine and case law from multiple countries) to establish measures that avoid possible controversies that stem from the joint management of the intellectual asset that is derived from the technologies developed during international cooperation. At its conclusion, Standard Operational Procedures (SOP) are proposed to subsidise the decision of managers and the legal team of institutions that engage in international cooperation activities for the development of patentable technologies with regards to the protection of their shared intellectual assets.Attribution-NonCommercial-ShareAlike 3.0 Brazilhttp://creativecommons.org/licenses/by-nc-sa/3.0/br/Cooperação InternacionalPatentesCopropriedadeInovação TecnológicaInternational CooperationPatentsJoint PropertyTechnological InnovationCoordenar para não falhar: a copropriedade de patentes produzidas em regime de cooperação internacional para o desenvolvimento de tecnologiasCoordinate to avoid failure: joint ownership of patents stemming from international cooperation for the development of technologiesbachelorThesis
