Based on a review of narrative literature, the main concepts related to the problematic are demonstrated, which are analyzed according to the precepts of the deductive method. In the first place, the City is investigated as its own phenomenon, aiming at the configuration of a concept that adds typical characteristics of the City throughout history in order to provide elements for the establishment of a proper legal concept of City, in the terms of the Brazilian legal system. Therefore, it’s discussed the Right to the City, properly speaking, as a social phenomenon and philosophical category, whose development becomes worthy of juridical shelter, making it, from then on, a true category of subjective right. In view of the legal and material presuppositions established in relation to the legal and material content of the Right to the City, it is demonstrated how to identify the presence of the Right to the City in the Brazilian legal system, deducing it from an interpretation of the Urban Policy Chapter of the Federal Constitution together with other units of the Brazilian constitutional system that specifically concern Urban Policy, especially Law 10,257 / 2001, self-titled City Estatue. Finally, a study is made of the Right to the City from the sociological point of view and how its effectiveness contributes to the formation of communities, where the feeling of belonging is fostered so that the individualities develop freely, being able to form their identities of according to the Belt of Belonging and identification to the values and feelings shared by that Community. Thus, it is tried to prove, based on a theoretical study undertaken, one of the hypotheses by which the implementation and effective concretization of the Right to the City is necessary, that is, the construction of a more balanced society, based on the sharing of values and feelings that give rise to the emergence of cities as communities to which their inhabitants feel themselves, thus satisfying the human need to feel part of a whole and effectively participate in the political decision-making process regarding the space they inhabit.Acesso AbertoDireito à cidadeAspectos jurídicosComunidadeIdentidadePertencimentoO direito à cidade - do fenômeno social ao jurídico: uma reflexão sobre comunidade, identidade e pertencimentomasterThesis
