Furthermore, it is part of a new global movement, called sharing economy, which uses stagnant goods and services by means of renting and lending over ownership, regulating itself through users ranking. Due to your success, Taxi companies have been felt threatened in their activities. According to them, Uber does equivalent activities to taxis’, without supporting the same onus as them. The present work aims to settle these controversies, analyzing, for this, the Law nº 12.587/2012, which characterizes the remunerated individual transport (public or private), and public service essential elements, intending to obtain its nature. Apart from this, it is necessary to visualise Uber from constitutional economic liberties (art. 170, caput; art. 170, IV) and consumer protection (art. 170, V) and pertinent infraconstitutional legislation - the Law nº 12.529/2011 (Brazilian System of Competition) and Law nº 12.965/2014 (Internet Civil Landmark). The present work also aims to look over regulatory projects now in vogue and if they are viable or not and if they have the necessary competence. Finally, it shows relevant aspects concerning to the challenge of regulating technological and social innovations and also suggestions to the theme.
