With the rapid evolution of biotechnology and genetic medicine, urgent ethical and legal issues demand legislators' attention. The research explores the evolution of law in this field, emphasizing the inadequacy of current regulations to address the complexities associated with the manipulation and use of genetic material. Utilizing a qualitative approach, the study employs a literature review and document analysis to identify the main shortcomings in current legal protections.The analysis includes a qualitative examination of national and international legislation, resolutions from the Federal Medical Council, and guidelines from international organizations such as UNESCO's Universal Declaration on the Human Genome and Human Rights. Emblematic cases, such as that of Italian doctor Severino Antinori, are discussed to illustrate the practical implications of legal gaps. The article also compares Brazilian regulations with those of other countries, seeking to identify best practices and legislative solutions applicable to the national context. Finally, the study proposes the need for a new legal paradigm that keeps pace with scientific innovations, ensuring the effective protection of human genetic heritage.
