It is known that, for reasons of marginalization and social erasure, many vulnerable or even hyper-vulnerable individuals are not considered in the structural decision-making process, even though there is a possibility that they will be seriously affected by the measures adopted. With this in mind, the specific objectives of the paper seek to present how these social groups can participate, directly or indirectly, in the elaboration of structural public policies, in addition to showing that the Public Defender's Office, as custos vulnerabilis, has a fundamental role in promoting democratic and collaborative decision-making by acting as guardian of the vulnerable. In light of this, this work is both exploratory and descriptive, as it investigates the custos vulnerabilis intervention while explaining concepts, for example, of problems, processes, and structural decisions. In addition, the methodology used was a bibliographical and documentary review, as the study was carried out based on the collection of data obtained from books, articles, theses, legislation, and jurisprudence. Finally, it was possible to conclude that the custos vulnerabilis is a rising modality of exclusive intervention of the Public Defender's Office, in its role of legitimized extraordinary, which makes it possible for its wide procedural action, such as the possibility of filing appeals and production of evidence.
