Mãe Luiza has amenities due to its geographical location that turn it into a desirable and coveted by area real estate market. Thus, from the Master Plan for Christmas 1994s, establishing special zoning areas of the city, both in terms of social interest, such as environmental protection. The work focused on the Special Zone of Social Interest (AEIS), governed by Law No. 4,663, dated July 1995, which provides for the use of land, boundaries and urban requirements of Mãe Luiza district 31 as well as the stated environmental protection corresponding to will the dunes adjacent to the lighthouse, proposed by the Master Plan of the city as the Environmental Protection Zone area 10 area. Accordingly, we investigated the evolution of the occupation and district Mae Luiza, its importance as a Special Area of Social Interest (AEIS), the impact of those rules on how to use and occupation of the neighborhood. We defined the overall objective to analyze the process of use and occupation of land in the neighborhood Mae Luiza, from its setting as AEIS and specific objectives, analyze historical aspects of the formation of the district, to identify events that marked their spatial evolution; review the law of use and occupation of the neighborhood and compare the requirements of that law with the social and spatial reality of the neighborhood. The analysis on the problem at hand is based on authors like Carlos (2000), Ribeiro (1997), Santos (1999), Duarte (2011), Bentes and Trindade (2011), Piglet (1978 ), Delgado ( 1992) and Fernandes (2000 ) that discuss : transformations in space , the production of housing , urban legislation; cities held ; Special Areas of Social Interest and evolution of urban space , especially the Mãe Luiza neighborhood. The methodology was based on three different times as: 1 - Bibliographies in books, articles, monographs, theses and dissertations; 2 - Documentary Survey Laws, decrees, annuals, master plans, etc., in addition to direct field survey, which gave support for the mapping of the study area and the photographic record; 3 - application of direct interviews with residents of the neighborhood and Mae Luiza people in the public sector. The Quarter Mãe Luiza originated in the 1940s, being made, even today, by a predominantly low-income population. Associated with this aspect, its geographical location in an area of dune formation was essential for recognition as an AEIS. Such recognition involved widespread social mobilization, given that the population feels threatened by the real estate market, whose shares already surround the territory of the district. Despite the legislation, it was found that there were cases of rape , especially as they relate to the standards regulating the construction of buildings. Finally , the survey revealed that the definition of the neighborhood as a AEIS produced different views among residents . Some consider that the legislation is a delay for the neighborhood because discipline and establishes restrictions on the use and occupation of land and if it were modified could attract people with higher purchasing power, so the power would channel public benefits to the community. Others perceive it as an instrument that ensures the conditions of stay of residents on site, just to restrict and regulate the action of the agents that produce the city space. Upon the foregoing, it is considered that the study of the district Mãe Luiza, the prospect of a legal approach on local reality, reveals the complexity involved in the construction of urban space, permeated by contradictions and conflicts.
