When caused by exogenous factors, the hospital-acquired infection may result from inadequate procedures, by the medical team, by the nursing team, or even by the hospital cleaning team. The aforementioned topic grows in importance to society for being bound to health and, consequently, to human dignity, two rights guaranteed by the Federal Constitution. In doing this work it was implemented a bibliographic research based on doctrine, legislation and other media. The study was arranged in four chapters: Public Administrative principles; health as a principle on the Federal Constitution; the mortality by hospital-acquired infection on the lack of prophylaxis by the State; and the State's extra-contractual accountability for the lack of prophylaxis in the hospital environment. It is possible to infer that the large number of lawsuits results from failure, or even absence, on the provision of a proper service. Thus, it is up to the Public Administration to supervise the health services rendered under penalty of accountability for damages caused to the life of citizens.openAccessInfecção. Hospital. Morte.
