However, deficiencies in the Unified Health System made it difficult to meet the population health needs. Changes in the population epidemiological profile add to technological advances causes increasing of the lawsuit for healthcare. This practice is called Judicialization of health. Among the demands in the area of health the processes that call for medicines stand out and in this segment one of the biggest financial impacts is linked to the antineoplastic drugs. This is a descriptive, exploratory and documentary study of lawsuits claiming antineoplastic drugs that have the state of Rio Grande do Norte as sole defendant or in a regime of solidarity with the other entities of the federation. The objective of this study is to evaluate the judicialization of antineoplastic drugs involving the State of Rio Grande do Norte from 2013 to 2017. The socio-demographic characteristics of the author; Procedural characteristics of lawsuits; Medical-sanitary characteristics of the actions and administrative political characteristics of the actions were evaluated. The data were analyzed by indicators taken from the manual "Evaluation indicators and monitoring of drug lawsuits". The results show that the global expenditure of the defined temporal scope was R $ 19,266,268.30, with a larger number of cases coming from the metropolitan health region (39.5%) and Mossoró (28.5%), (44.7%), female, between 61 and 70 years (31.4%), with a more predominant diagnosis of breast cancer (19.3%). Represented by public defenders (53.7%). Most of the individuals (81.2%) had access to the medication, which had a purchase made mostly by the author of the action (81%).
