The hypothetical-deductive method and the case study were used to complete this work. In addition, bibliographical references relating to the work and both Brazilian and East Timorese legislation dealing with the subject were used. The search for the truth in criminal proceedings is very important because the State-judge cannot use its force arbitrarily against its own citizens because its fundamental role is to protect its population, particularly those most in need. Furthermore, it is necessary to have a dialogue about the search for truth in criminal proceedings because the truth itself gives the courts the confidence to decide or seek an appropriate solution so that they can bring the case to a close.
