Furthermore, the present work intends to make a critical analysis of the jurisprudence of the Federal Supreme Court and the Superior Court of Justice, based on the investigation of three leading questions, concerning the (dis)respect for the reserve of law and proportionality in these courts. Thus, the objective is to bring a minimum systematization to the subject and clarify the main problems involving breaches of secrecy of telematic data in the light of the fundamental right to the protection of personal data. In the first two development chapters, bibliographic research was used, while in the third a qualitative jurisprudential research was made.
