It makes use of qualitative research with the inductive method in bibliographic and documental analysis. Comprehends that the law mediates the socialization and that communication is fundamental in the formation of public opinion and consensus in modern societies, through a procedural model, which promotes ideal and democratic discursive conditions. Verifies the establishment of a participatory procedural model and the system of precedents in the national court system, as well as the duty of reasoning in court decisions, avoiding arbitrariness and strengthening judicial security.
