This analysis will consider the doctrinal discussions surrounding the mentioned norm and the constitutional principles of human dignity, equality, and freedom, as well as the principles of family law, such as free choice, variety, and mutability of property regimes. Additionally, the issue of legal capacity will be addressed, as the norm imposes a form of forced incapacity based on age. To conduct the study, a historical overview of the rights of the elderly will be conducted, exploring the Statute of the Elderly, along with a comprehensive analysis of the constitutional principles applicable to family law and property regimes.
