Despite its administrative and informative nature, the IP is frequently the only element considered by the Public Prosecutor’s Office before initiating a criminal case. In many instances, it lacks supporting documentary, expert, or testimonial evidence. The issue becomes more concerning when the judicial phase fails to produce new evidence, leaving only the police authority’s interpretation as a basis for conviction. Such practice violates key constitutional principles, including the presumption of innocence, the adversarial system, and the right to a full defense. This study uses bibliographic and exploratory research with a qualitative approach and draws from the works of Aury Lopes Júnior, Guilherme Nucci, Brazilian legislation, and case law.
