This present paper analyzes the regulation of the use of energy efficiency by private oil exploration and production companies as a factor of development and sustainability in Brazil. It presents structuring concepts, which are environment, sustainable development and energy efficiency, that supports the exploratory-descriptive study, using the deductive research method. It investigates if the maintenance of the ecologically balanced environment, inserted in the art. 225 of the Constitution, as a "must-be" rule, is observed by private companies that exploit and produce oil, natural gas and biofuels.
