Monografia (Graduação em Direito), Universidade Federal do Rio Grande do Norte, Natal, 2019.https://repositorio.ufrn.br/handle/123456789/51597The purpose of this work is to analyze the possible admissibility of independent candidacy by the Brazilian Supreme Court, a discussion that gained prominence after the attribution of general repercussion to the Extraordinary Appeal under number 1.054.490/RJ, which is still awaiting trial. To this end, the historical and political contexts in which Brazil was inserted were studied, with emphasis on political parties, from the empire to the enactment of the 1988 Constitution, which brought party affiliation as a condition of eligibility and, consequently, prohibited the figure of independents candidacies. The influence that discredit the Brazilian political parties exerts on the debate on the subject was also discussed. In sequence, it was investigated whether there were sufficient legal arguments to support the admissibility of these candidacies through the Brazilian Supreme Court. Finally, some reflections were made on the consequences that the admissibility decision could have on the legal system and on the Brazilian electoral system, as well as on whether the Court would be the right place to discuss this problematic. As a methodological procedure, it was used the bibliographic review of specialized literature, academic works, scientific articles and analysis of the legislation, in addition to the deductive method to reach a conclusion on the feasibility of the Brazilian Supreme Court admitting independents candidacies.Candidaturas avulsas.
