Over time, this control has undergone several modifications and changes in understanding. Currently, there is a discussion about the possibility of control, by the Judicial Power, of government acts that are the responsibility of the authorities belonging to the Executive Power. In this perspective, the present work aims to raise discussions about the possibility of external control of acts of free nomination, conjecturing whether there may be jurisdictional control of the act or not and what its possible limits would be. For this purpose, a study is conducted over the functions of the State and the concept of misuse of power. It is also discussed about differentiating between the types of freely nominated positions and an analysis of the legal nature of each person's nomination is made. Also, decisions on cases of control of the act of appointment exercised by the Judicial Power are analyzed, exposing the views of the Ministers of the Supreme Federal Court on the subject.
