Although a considerable framework of normative firmly guarding the family core of women in conflict with the law, these group of women still faces numerous obstacles to preserving it. Such obstacles often reinforce the incompatibility between prison and the exercise of the right to motherhood. In this sense, the present work has the general objective of ascertaining, through a constitucional and procedural criminal examination, the real obstacles to the maintenance of family cores by women prisoners, especially in view of the banalization phenomenon of the institute of pre-trial detention. It has the specific objectives of understanding the evolution of the concept of family and its pratical ineffectiveness when applied to the reality of incarcerated women; to unravel the normative guidelines that aim to protect both family in the broad sense and the family of the woman in prison; to examine critically the conformation of female prison units and develop a thorough study of the institute of pre-trial detention and its nuances. This is a descriptive, exploratory and interventionist research. In the end, in order to ensure greater protection for such families, it is proposed to expand socio-assistance policies to house arrested women, as well as drug law reforms.Processo penal.
