The powers and sanctioning power of the Courts of Accounts have always raised doubts and promoted hermeneutic debates in the doctrine and jurisprudence of the higher courts, so that it is necessary to ascertain, within the scope of external control of public tenders and contracts, the extent of their powers and limits applicable to the sanctioning power exercised by the TCE/RN? The investigation will be carried out through a theoretical-descriptive research, with the methodology recommended by legal dogmatics, based on a normativist perspective of Law, but which recognizes the importance of legal principles in the Positive Law system. In order to resolve such issues, it is intended to identify: i) the origin and evolution of the sanctioning administrative law exercised by the TCE/RN; ii) explore the types and legal nature of the administrative sanction contained in the federal bidding and contract laws, as well as those applied by this control body and; iii) study the limits applicable to the sanctioning administrative law exercised by the Potiguar Court of Accounts in terms of public tenders and contracts.
