It is based on the assumption that incarceration in Brazil has its roots in socio-historical determinations that date back to its socio-economic formation, and social relations marked by authoritarianism, racism, and patriarchy. In this direction, the research problem is delimited by questioning how the set of structural mediations of Brazilian socio-historical formation and patriarchal gender relations and the objectification of current criminal policy affect the increase in women's incarceration, especially in the reality of Rio Grande do Norte (RN). For this, a bibliographic research was carried out on Brazilian socio-historical formation; the Marxist critique of the complexes of law and the State; criminal policy, incarceration, and critical criminology; and patriarchal gender relations and their mediations with the justice system, situating the phenomenon of women's incarceration in the Brazilian reality in the context of ultraneoliberalism. A documentary research was also carried out, with data from the National Penitentiary Department's (DEPEN) biannual reports and its National Penitentiary Information System (SISDEPEN). The time frame for the analysis was delimited between 2006 and 2020. To answer the research problem, the mediations between the socio-historical determinations of incarceration in Brazil, racism as a structure of social relations, patriarchal gender relations, and current criminal policy were analyzed. Thus, it was possible to apprehend the existing relationship between social production/reproduction and the phenomenon of women's incarceration in Brazil and its particularities in Rio Grande do Norte (RN), in order to elucidate the increase in incarceration of this segment in the state. Information relating to the Brazilian prison population between 2006 and 2020 was analyzed, particularly the number of women; the number of prisoners by regime; the total length of sentence they were sentenced to; the criminal typification; race/ethnicity, age range, and educational level. Historical-dialectical materialism was adopted as the method of analysis, as it identifies the instruments that make it possible to elucidate, in the entirety of the historical process of women's incarceration in Brazil and its most concrete determinations, without disconnecting it from the organic whole that integrates it. Thus, it was concluded that there is a profound connection between the historical racism of Brazilian society, patriarchal gender relations, the criminalization of poverty, and the punitive criminal policy of current neoliberalism in the country. The actions of the justice and criminal system, together with the elaboration of new criminal laws that expand criminalization, have generated a great mass incarceration in the country, in which more and more women are being imprisoned. They are mostly black, with incomplete primary education, young, and imprisoned for drug-related and property crimes.
