TCC (Graduação) - Curso de Direito, Centro de Ciências Sociais Aplicadas, Universidade Federal do Rio Grande do Norte, Natal, 2023.https://repositorio.ufrn.br/handle/123456789/52985The paper analyzes the evolution of the negotiations for regulation of the carbon market, from the Kyoto protocol, to the implementation plan of Sharm El-Sheikh, going through the Paris Agreement, the recent pact signed in Glasgow during COP 26, the discussions of COP 27, conducted in 2022 in Egypt, and the Brazilian legal framework, highlighting the difficulty of regulating the carbon market under the tutelage of Article 6 of the Paris Agreement. Thus, due to the need for greater rigidity to the commitment to mitigate the human impact on the environment, in particular observation of the theme of climate change, the present work investigates how this important developing tool is structured and how it can contribute to the global strategy to combat climate change, from a synergistic, conscious and sustainable development perspective, in adherence to goal 13 of the 2030 Agenda, namely: action against global climate change. In this line of reasoning, it also addresses the Brazilian case and the challenges for its protagonism in this field, passing the diagnosis formulated by the National Confederation of Industry (CNI) and internal regulations on climate issues from their adequacy to international provisions.
