The research examines the legal foundations, practical challenges and advances in implementing this fundamental right. By addressing constitutional aspects and specific laws, the analysis aims to contribute to the improvement of inclusive educational policies. The investigation is based on a review of current legislation, including the Federal Constitution and the Brazilian Law on the Inclusion of Persons with Disabilities.
