| Portuguese Abstract: | Esta pesquisa tem como finalidade difundir a informação a respeito do fator previdenciário, a partir da proposta de reforma do regime de previdência social, através da Emenda Constitucional Nº 20/1998, e sua repercussão no equilíbrio atuarial da previdência pública, em um contexto geral e direcionando para o fundamento da criação do índice de redução com base na Lei Ordinária Nº 9.876, de 26 de novembro de 1999. Utilizar-se-á o método dedutivo com o propósito de estudar o desenvolvimento a cerca do tema tratado, desde as disposições previstas na Lei Maior, que antecede a reforma, convergindo para o aspecto detalhista da metodologia. O objeto de estudo ampliado é o entendimento do cálculo, bem como os casos de incidência e não incidência do fator, com fundamento no ordenamento jurídico e discussão anterior em audiências públicas para este propósito. É de suma importância a compreensão no tocante a aplicabilidade do redutor, para que o trabalhador tenha o conhecimento não do cálculo em si, mas da influência do multiplicador em relação a sua decisão quanto à escolha da aposentadoria precoce. |
| Abstract: | This research aims to disseminate information about the Social Security factor, from the proposed reform of social security system, through Constitutional Amendment N. 20/1998, and its equilibration on the actuarial balance of public security, in a general context and directing the foundation for the creation of the reduction index based on Statutory Law N. 9.876 of November 26, 1999. It will use the deductive method in order to study the development around of the theme treatise from the provisions of the Higher Law, that predates the reform, converging to the detail aspect from the methodology. The object of study is the understanding of the calculation as well as the cases of incidence and no incidence of the factor, based on law and previous discussion at public hearings for this purpose. It is extremely important understanding the concerning of the applicability of the gear unit to the employee has the knowledge not only of the calculation itself, but the influence of the multiplier in relation to its decision about the choice of premature retirement. |
