A Lei nº 5.399/22 e a proteção ao patrimônio cultural em Caicó/RN

Abstract

The Law No. 5,399 of June 1, 2022, which addresses the preservation of the Cultural Heritage of the Municipality of Caicó, establishes the Municipal Council for Cultural Heritage and institutes the Municipal Fund for the Protection of Cultural Heritage of Caicó/RN, was created and approved in response to the public outcry caused by the demolition of a historic building in the city. The law follows the guidelines of the Federal Constitution of 1988 and federal legislation on the subject, focusing on the instruments of listing (tombamento) and registration (registro). However, its implementation has been limited, which compromises its effectiveness. In this context, this study seeks to analyze Law No. 5,399/22 in light of federal and state legislation, as well as the guidelines of Article 216 of the Federal Constitution. The objective is to provide a comprehensive view of the potential of the new law in the current scenario of cultural protection in the city of Caicó/RN. The methodology used is based on qualitative bibliographic research, with consultation of scientific works, legislation, websites, and social networks pertinent to the defined theme. It is concluded that administrative efforts and popular participation are lacking to ensure the effective application of the aforementioned law
