Therefore, this work is focused on the study of the requirement of a formal and circumstantial confession based on the principles of innocence presumption and prohibition against self-incrimination. The main problem regarding the present paper revolves around verifying the compatibility of the confession with the consensual justice, with the principles of innocence presumption and prohibition against self incrimination and the limits regarding the use of the confession as proof in the criminal persecution. Regarding the research procedures, the present paper applies a deductive method, with a research of qualitative, bibliographic and documental nature, by analyzing legal doctrine, law and jurisprudence regarding the subject.
