In this sense, the importance of this type of logistics infrastructure, from production to consumption of goods, and the benefits of regulation, based on the freedom of competition, to reach the long-awaited Brazilian development. That development involves an endless series of modifications in a way that leads to a radical change of economic, cultural, psychological and political structure, whose purpose is to provide a better quality of life and well-being of society. It runs through the historical problems of the Brazilian port sector and its inefficiency, with vexatious indices, which can lead to the stagnation of the sector and, consequently, the market. It also, travels through Brazilian port legislation, highlights the entry into force of the new regulatory framework for the port sector, with a view to reformulating this scenario, and to the main changes introduced by Law 12.815 of June 5, 2013, highlighting the innovations that allowed the institution of asymmetric competition, especially that of the private use terminal, in which they reflect directly in the activities of this area.openAccessDesenvolvimento Econômico.
