    The expropriation for public utility is one of the ways the Public Power acts to achieve essential works and services for society. However, while the Brazilian Federal Constitution of 1988 envisions an early cash fair compensation, it is clear that before the public’s megaprojects, the presence of social impact in expropriated people’s housing rights, especially when it comes to communities connected by neighborly, cultural, and economic ties. Therefore, the present study aims to comprehend the fundamental housing rights realization in the expropriation process for public utility, analyzing the compensatory measure that turns the State intervention fair, having as reference the emblematic potiguar case of Nova Barra de Santana, an urban area located in Jucurutu/RN city, for the Oiticica barrage’s implementation. To achieve this purpose the present work employed the deductive method with documentary and bibliography research, as well as the empiric method as support to comprehend the chosen case. Thus, among the revealed results, it was perceived, in general, that the Nova Barra de Santana’s housing policy, because of its implementation form, allowed the balance between private and public interests, such as the affected people’s fight to secure their rights. Finally, it was concluded that the implemented compensatory measure by exchange ensured housing security for people without property titles, such as the ones that only had possession or lived in “borrowed” properties.
