| dc.description.abstract | Over-indebtedness is characterized by the impossibility of the individual to pay all his debts of consumption, result of the expansion of unbridled credit supply, a fact that generates an accumulation of obligations to be met, disturbing the family structure and the psychological structure of the debtor. In this way, it aims to address the issue of over-indebtedness of Brazilian consumers in the context of the legal system post Federal Constitution of 1988, analyzing payment capacity and the profile of overindebted, bringing the doctrinal construction of the theme: concepts, requirements, causes and effects and discussing the legal protection given to the matter, including PLS 283/2012, which aims to put reforms in CDC. | |
| dc.description.resumo | Caracteriza-se o superendividamento pela impossibilidade do indivíduo de pagar todas suas dívidas de consumo, resultado da expansão desenfreada do fornecimento de crédito, fato que gera um acúmulo de obrigações a serem cumpridas, abalando a estrutura psicológica e familiar do devedor. Objetiva-se, dessa forma, abordar a questão do superendividamento dos consumidores brasileiros no contexto do ordenamento jurídico pós Constituição Federal de 1988, analisando a capacidade de pagamento e o perfil dos superendividados; trazendo a construção doutrinária do tema: conceitos, requisitos, causas e efeitos e discutindo a tutela legal dispensada à matéria, inclusive o PLS 283/2012, que visa inserir reformas no CDC. | |
