| dc.description.abstract | Given that Brazil does not have regulations for homeschooling practices, nor provisions that prohibit it, research is conducted on the regulation of homeschooling, also known as education domiciliary, in order to analyze the compatibility of Bill No. 1,388/2022 - which deals with the regulation of homeschooling - with Brazilian legislation. Therefore, it is necessary to investigate the concept and implementation of homeschooling throughout history, as well as its application in the international and national scenarios; analyze the decision of the STF on RE 888,815/RS, under the rapporteurship of Minister Luís Roberto Barroso, creating a lasting precedent for the Brazilian educational reality; finally, investigate whether there is compatibility between Bill No. 1,388/2022 and the Brazilian legal system, elucidating principles such as educational freedom and pedagogical pluralism, subsidiarity in the social right to education, and the comprehensive protection or best interests of the child, in addition to compliance with human rights treaties to which Brazil has committed itself before the international community. Therefore, a strategic basic research is conducted with a descriptive objective, based on documentary and bibliographic investigation of a qualitative and hypothetical-deductive nature. Finally, it is verified that the general objective of the research was met by reaching the conclusion that there is compatibility between Bill No. 1,388/2022 and Brazilian legislation, valuing the triad of interests involved: family, student, and the State. | pt_BR |
| dc.description.resumo | Tendo em vista que o Brasil não possui regulamentação para prática da educação domiciliar, nem dispositivos que a proíbam, pesquisa-se sobre a regulamentação da educação domiciliar, também conhecida por homeschooling, a fim de analisar a compatibilidade do Projeto de Lei Nº 1.388/2022 – que versa sobre regulamentação da educação domiciliar – com a legislação brasileira. Para tanto, é necessário investigar o conceito e a aplicação do homeschooling ao longo da história, assim como sua aplicação no cenário internacional e nacional; analisar a decisão do STF sobre o RE 888.815/RS, de relatoria do ministro Luís Roberto Barroso, criando um duradouro precedente para realidade educacional brasileira; por fim, investigar se existe compatibilidade do Projeto de Lei nº 1.388/22 com o ordenamento jurídico brasileiro, elucidando princípios como o da liberdade educacional e pluralismo pedagógico, da subsidiariedade no direito social à educação e da proteção integral ou do melhor interesse da criança, além da observância aos tratados de direitos humanos os quais o Brasil se comprometeu perante a comunidade internacional. Realiza-se, então, uma pesquisa básica estratégica com objetivo descritivo, baseando-se na investigação documental e bibliográfica de natureza qualitativa e de caráter hipotéticodedutivo. Por fim, verifica-se que o objetivo geral da pesquisa foi atendido ao se chegar a conclusão de que há compatibilidade do Projeto de Lei Nº 1.388/2022 com a legislação brasileira, prezando pela tríade de interesses envolvidos: família, educando e Estado. | pt_BR |
